HUD Renter's Rights

The United States Department of Housing and Urban Development, or HUD, maintains a list of renters' rights. These rights consist of federal laws, guidelines and procedures that apply to all states.

  1. Types

    • HUD's renter protection laws include fair housing laws that prohibit discrimination against a renter because of his race, national origin, familial status or religion. Additionally, federal renters' rights laws ban discrimination against a potential renter due to his disability. HUD regulations mandate that landlords keep rental housing in a livable condition.

    Duties

    • HUD laws allow a tenant to file a complaint against her landlord for violating HUD tenants' rights statutes. HUD can levy fines against landlords who do not follow tenants' rights statutes. Additionally, HUD can ban noncompliant landlords who provide federal low-income housing from doing business with the federal government in the future.

    Considerations

    • The HUD tenants' rights laws are federal laws that offer only basic protections to all tenants in the United States. Individual states make the majority of tenants' rights laws. These laws can vary widely from state to state.
