Copyright Law: Use of Primary Documentation Publication
Whether a person is a business owner, student, teacher, preacher or from another walk of life, it is always a good idea to know when and how to use other written sources without being in danger of plagiarism and in violation of copyright law.
-
Primary Documentation Publication Protection
-
Copyright law was created to protect the rights of the owner of "original works." An original work publication is the first of its kind. Primary documentation publication is also a first-of-its-kind publication. A primary documentation publication is a fact-based publication such as a news article or report and this type of publication is protected by United States copyright law.
According to copyright law, if an individual creates an original work or primary documentation publication they become sole owner of that original work. The individual then has the right to determine how when, and where that work may be used.
Copyright Defined
-
United States copyright law defines copyright as a form of protection to the authors of "original works of authorship." These original works include literary, dramatic, musical, artistic and certain other intellectual works. Copyright law protects these original works from being reprinted, published, copied or sold for profit by a third party.
-
Permissible Use
-
According to the Copyright Act, 17 U.S.C. 106 and 107, reproduction is permissible, in certain instances, for purposes such as "criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research." When using copyrighted works for your projects, such as fact-based books, news articles, historical documents and literary works, keep in mind that the primary documentation publication must be attributed to the originator of the original works at all times.
