If someone is a private tutor and receives payment for tutoring services, then he is running a tutoring business. Whether one has to register the business with the state of operation depends on the legal structure chosen for the business.

In most states, businesses that are run as sole proprietorships or general partnerships do not have to be registered with the state corporations bureau. General partnerships may, however, have to register with the state's revenue department. Further, a sole proprietor or general partnership may register a fictitious name or "Doing Business As" (DBA) name if it does not want to use the names of the owners.

This is usually done through the corporations bureau of the state's Secretary of State or State Department.
