Child restraint laws are enforced to protect your children.

The North Carolina Child Passenger Safety Law enforces safety regulations for children under the age of 16 that are passengers in motor vehicles. The age and weight of the child will determine the type of restraint that is required. All restraints must meet federal standards.

  1. Requirements

    • A child restraint device must be used in a vehicle for any child who is under the age of eight and weighs less than 80 lbs. Once a child reaches either the age or weight requirements, he can ride in the vehicle without a child restraint device but must wear a properly fitting seat belt. If the child is over 40 lbs., a booster seat may be used.

    Position

    • The child restraint device must be placed in the rear seat if your child is under the age of five and 40 lbs., the vehicle has a backseat and comes equipped with a passenger air bag. If you are using a child restraint device that is designed for use with air bags, it is allowed to be installed in the front seat.

    Penalties

    • Drivers of the vehicle are responsible for all passengers under the age of 16. If you do not follow the North Carolina Child Passenger Safety Law and are issued a citation by a police officer, you could lose two driver license points and may have to pay a small fine of $25 or less as well as court costs of $141.
