Colorado Tenant Rights

A rent-paying tenant in Colorado is entitled to rights granted to her by law and her landlord. A lease, or written rental agreement, defines the rules between a landlord and tenant for the rental unit and duration of her stay.

  1. Function

    • A lease has many components that determine what rights a tenant and a landlord has. If a landlord tries to unlawfully alter or break a lease agreement, the tenant can take him to a Colorado court, provided she has a written lease and not a "verbal" or "oral agreement" with her landlord.

    Features

    • Leases identify the number of tenants living in the rental unit, rent amount and due date, security deposit if required, late fees for missed payments, home maintenance responsibilities and whether pets can live on the premises. A landlord may request to amend a lease agreement, but the tenant has the right to refuse.

    Misconceptions

    • If a lease required that a tenant pay a security deposit, Colorado law requires that the landlord return the deposit in full within 30 days of her moving out or give her a written list of damages she caused with costs. The landlord cannot keep any money to cover normal wear and tear.
