Alabama Tenant Rights
Alabama has tenant and landlord laws. This not only protects the landlord but also the tenant. The landlord must keep up and maintain the property for the tenant. The landlord tenant laws will protect you in case you are wrongfully evicted or your landlord does not uphold his duties.

Habitable

The rental property must be habitable with working water, heat and electricity for each tenant's use. Each tenant must be provided with hot and cold water. They must also be provided heat for winter months.
Break a Lease

By law in Alabama, if the landlord does not fix or correct a major health or safety issue, the tenant can move out. This means if the water or heat quit working, the tenant has the right to leave. Also, if signs of mold are present and it causes you illness, the tenant can break the lease.

Security Deposits

In Alabama, the security deposit for a rental property cannot be more than one month's rent. The landlord can only charge more if you have pets.
Returning Security Deposit

Alabama tenant law states that after you move out, the landlord must return the security deposit within 35 days. If any money was used for repairs from the deposit, it must be noted.
Inspection

A landlord must give a written two-day notice before entering the rental property. They are only able to enter without a written two-day notice if it is an emergency.
Garbage

Landlords are required to provide garbage receptacles. Tenants are required to dispose of their own garage.
