Rights for Temp Workers

Rights for Temp Workers thumbnail
Temporary workers have rights.

Although the workload may differ between temporary workers and permanent employees, their rights on the job do not. As the United Nations states in its Universal Declaration of Human Rights, every person has the right to just and favorable conditions on the job.

  1. Necessity

    • Temporary workers must receive at least the minimum wage. For example, in 1996 the U.S. Department of Labor fined two Massachusetts temp agencies $150,000 each for depriving their temp workers of fair wages, in violation of the Fair Labor Standards Act.

    Considerations

    • Further protection of U.S. temp worker rights comes from the Migrant and Seasonal Agricultural Worker Protection Act, which regulates wage and safety standards for seasonal agricultural workers. However, temp workers sometimes lack the same benefits as permanent workers, making affordable health care harder to reach.

    Resources

    • The Equal Rights Advocates promotes equal rights for women in the workplace, and emphasizes the equal right for temp workers to be protected from discrimination. The ERA operates a free advice and counseling hotline for female temp workers concerned about violations of their rights.
