Legal Proceedings

According to the Suffolk County 10th District Court, Landlord Tenant Court allows both parties to iron out issues. Landlords and tenants have the right to summary proceedings which can include failure to pay rent or special proceedings for health and safety issues with the property.
Eviction

If you have been served with an eviction notice, the Suffolk County Landlord Tenants Court allows issues to be resolved. The landlord must notify you in writing before you can be legally evicted. The 10th District court also says, "You must appear in court on the date and time stated in the Notice of Petition served on you." If the eviction is due to your non-payment of rent, pay it in full to resolve the issue.
Landlords can not force tenants to move by turning off the utilities or blocking access to the rental property. Small Claims Court allows tenants to sue a landlord for "three times the damages you suffer," according to Nassau Suffolk Law Services.

Repairing Your Apartment

Don't assume you can pay for repairing your apartment and deduct the amount from your rent. The Nassau Suffolk Law Services recommends tenants contact their landlord in writing to give them the opportunity to fix it themselves. If your landlord does not respond in a timely manner, you can pay for the repairs.
It's recommended you keep all estimates, receipts and paperwork for repairs. A judge will ask for these items if the issue goes to court.
