According to Emory Law, divorce law in Malaysia is governed under both Muslim and non-Muslim law. Non-Muslim divorce is based on English common law, as the U.K. took control of the region in the 19th Century.

  1. Talaq

    • The BBC News website reports that Muslim law allows the husband in a marriage to announce his divorce from his wife by speaking the word "Talaq" three times in her presence. Emory Law explains that the husband must apply to the Muslim authorities to use the Talaq process.

    Women

    • Muslim women in Malaysia have an equal right to divorce, under certain circumstances listed under Muslim law. The reasons women may apply for divorce include a husband's refusal to consummate a marriage for 4 months, his disappearance for over 1 year or his imprisonment for over 3 years.

    Non-Muslim Divorce

    • The Financial & Legal Matters website explains that non-Muslim people can apply for divorce through a judicial court. The Law Reform Act of 1976 allows couples outside the Muslim faith the right to divorce.
