The court in Taiwan tends to look at cultural ideas and stereotypes concerning gender when dealing with divorce and child custody proceedings. Judges are also influenced by economic conditions and public welfare programs, or lack thereof.

    • Divorce in Taiwan has been considered a law meant to help women escape troubled marriages.

    Reconciliation

    • Judges are supposed to pressure the couple to reconcile instead of divorce in Taiwan divorce proceedings. Since this policy can disadvantage women by not allowing them out of a bad marriage, judges in Taiwan don't favor reconciliation.

    Child Custody

    • As of 1996, child custody has been viewed in terms of what's best for the child. Taiwan courts tend to favor the mother in child custody cases.
