Minnesota Construction Law

Minnesota's attorney general suggests you hire a licensed contractor for construction.

The state of Minnesota has several construction-related laws aimed at protecting consumers. These include warranties, insurance requirements for licensed contractors and a fund to help homeowners who are not satisfied with a contractor's work.

  1. Hiring a Contractor

    • The Office of the Minnesota Attorney General suggests you hire a licensed contractor. A contractor who does not have a license may not have proper insurance, and you will not have access to the Contractor Recovery Fund if something goes wrong.

    Warranties

    • Every construction project must carry a state-mandated warranty against most defects. This warranty is in place regardless of any other warranties to which the parties agree.

    Contractor's Recovery Fund

    • The Contractor's Recovery Fund protects the homeowner if a contractor fails to complete the contracted duties. If the consumer wins a legal judgment against the contractor, but is not able to collect, part of the judgment may be paid from the fund. The maximum fund payment is $75,000 per claimant or $150,000 per contractor.
