Copyright settlement agreements arise from conflicts over copyrighted works; most frequently, music, books and film. Settlement agreements allow disputing parties to reduce legal costs, avoid lengthy court proceedings and release creative works to the public without conflict.

  1. Copyright Basics

    • Copyrights exist automatically in the United States for all "original works of authorship fixed in any tangible medium of expression," but you must register with the Copyright Office to legally enforce copyrights.

    Dispute Settlements

    • Copyright settlement agreements explicitly address and resolve disputes over copyrighted material. For example, if an infringing party agrees to pay a fee or percentage to use a copyrighted work, the terms of that financial arrangement will appear in the settlement.

    Infringement

    • Copyright infringement occurs whenever a "copyrighted work is reproduced, distributed, performed, publicly displayed, or made into a derivative work without the permission of the copyright owner. " Infringement settlements usually require licensing agreements and/or fee payments.

    Ownership Disputes

    • Copyright ownership disputes arise when more than one author claims the right to a work. In these cases, settlements will define ownership explicitly. Where the dispute may have delayed publication or release of a copyrighted work, the settlement lays out how and when the work may become available to the public.
