Regulations for Filing Bankruptcy
Every bankruptcy court in the country abides by federally mandated regulations, according to the United States Bankruptcy Court for the Western District of Michigan and the book "How to File for Chapter 7 Bankruptcy."
-
Court Costs
-
Generally, debtors must pay to declare bankruptcy and must hire their own legal help if required; as of 2010, it cost $299 to file for Chapter 7 debt relief and $274 to request a partial debt repayment plan in Chapter 13, according to "How to File for Chapter 7 Bankruptcy."
341 Requirements
-
All personal bankruptcy petitioners must attend a 341 hearing, warns the United States Bankruptcy Court for the Western District of Michigan. This hearing allows creditors to exercise their legal rights to dispute a debtor's bankruptcy case.
-
Ineligible Debts
-
No bankruptcy judge can forgive financial obligations arising from child support, alimony, tax bills less than three years old, court fines or civil damages related to any illegal acts.
Student Loan Considerations
-
Only in the most serious cases of permanent disability will a bankruptcy judge reduce or eliminate federally issued student loans.
