Pennsylvania DUI Law on Driver's License Suspension
In Pennsylvania, it is possible for an individual convicted of driving under the influence (DUI) of alcohol or drugs to have his license suspended. The length of time of license suspension depends on whether he has been convicted of a DUI in the past and his blood alcohol concentration (BAC) level.

No Suspension

First time offenders charged with driving under the influence will not lose their license if it is their first offense and the BAC is below .10.
12-Month Suspension

An individual caught driving with a BAC between .08 percent and .10 percent may have his license suspended for a year. License suspension will only occur if an individual has a prior arrest for driving under the influence. An individual with a BAC of .10 percent to .159 percent will have his license suspended for one year on the first and second arrest. An individual with a BAC at .16 percent or higher will have his license suspended for one year if it is his first offense.

18-Month Suspension

An individual with a blood alcohol concentration between .10 percent and .159 percent may have her license suspended for 18 months. An 18-month suspension occurs if she has two or more prior DUI arrests. An individual with a BAC of .16 percent or higher will receive an 18-month license suspension if she has one or more prior DUI charges.
