Montana tenant rights come from state law.

While not receiving the benefits of equity appreciation coming from home ownership, apartment tenants in Montana do receive protection from Montana-mandated rights. As with other rights, these tenancy rights come with responsibilities.

  1. Basics

    • According to the University of Montana, three major pieces of state legislation support tenants' rights: the Landlord Tenant Act (LTA), the Security Deposit Act and the Mobile Home Act. The LTA comprises the most extensive coverage of tenant rights and responsibilities.

    Examples

    • In the case of lease agreements, landlords may not raise tenants' rent during the course of the lease. Rented spaces must be habitable, with all utilities in good repair and with common areas reasonably clean. The landlord must also disclose his or his designated agent's name and address.

    Implications

    • While the rights of Montana tenants may not change except through legislation, upholding tenant responsibilities will aid the landlord/tenant relationship and contribute to a landlord's consideration of tenant rights. Such responsibilities include keeping the rented space clean and sanitary, as well as disposing of waste properly.
