In the event of a car accident in Illinois, the guilty party will be held liable and pay for all damages through his auto insurance policy. Under Illinois law, all drivers must have at least $20,000 in coverage for the death or injury of one person, $40,000 for deaths or injuries of multiple people and at least $15,000 in property damage coverage.
Statute of Limitations

An Illinois resident who is involved in a car accident has only a certain amount of time to file a claim against the guilty party. If the accident causes personal injury, the victim has two years in which to file a claim. The statute of limitations on property damages resulting from a car accident is five years.

Proportional Comparative Fault

Illinois has adopted the proportional comparative fault policy within the state. This policy places limits on who can sue in the event of a car accident. Under the policy guidelines, a driver who is 51 percent or more responsible for the accident may not sue for any damages, regardless of his level of injuries.
