The Divorce Law in Thailand

In Thailand, divorce can be filed by mutual consent or court judgment. With a court judgment filing, there must be acceptable grounds for the divorce.

  1. Mutual Consent

    • To qualify for this divorce, you must have married at your local registrar office in Thailand. If the divorce is consensual with no disagreements, this divorce can be completed in one day. The divorce agreement must be written in front of two people and you must show the marriage certificate, passport and national I.D. card to the registrar office.

    Court Judgment

    • If the divorce is contested, you must approach the court for a "for cause" divorce. Either you or your spouse must be a resident of Thailand. If one of you lives overseas, you will have to make a court appearance in Thailand. All documents must be in Thai. If they are not, you will need to have them translated and notarized by the embassy in Bangkok. This divorce can take up to a year.

    Grounds

    • The husband recognizing another woman as his wife is grounds for divorce. Adultery on the wife's part is grounds for the husband to file for divorce. Other reasons include insanity, criminal misconduct, abuse and a separation of three years.
