Tenant Liability Rights for Trespassing

When a tenant rents a property from a landlord, the tenant is entitled to certain rights, including the right to privacy. Tenants can take legal action against landlords who violate this right.

  1. Tenant and Landlord Rights

    • Tenants have the right to live in their rental premises without harassment from their landlords. Landlords also have the right to reasonable entry to make repairs, inspect damage to the property in preparation for repair and for other legitimate reasons.

    Trespassing

    • Even though a landlord or property manager legally owns a property, the tenant is the presumed legal owner. If a landlord enters the rental premises without permission of the tenant and/or without giving advanced notice and providing a legitimate reason, landlords can be held liable for trespassing.

    Eviction and Trespassing

    • Once tenancy ends and if a lease or rental agreement is not renewed or extended, the tenant's right to privacy technically ends. However, landlords cannot verbally or physically harass or threaten tenants or forcibly evict them or their possessions. Only local law enforcement officials have the legal authority to physically remove someone.
