In addition to the protections offered by California landlord-tenant law, renters in San Francisco are protected by local ordinances as well. These protections include rent control, which minimizes rent increases and provides stringent requirements for tenant eviction.

  1. Rent Control

    • Many, but not all, rental properties in San Francisco are subject to rent control. This means that rent increases are limited to an amount set by the San Francisco Rent Board. Rent increases are based on inflation as well as the specific needs of the landlord to improve the property.

    Evictions

    • If you live in a property that is subject to rent control or "just cause eviction," your landlord generally is prohibited from evicting you unless she can prove one of 14 "good causes" for your eviction. These good causes include non-payment of rent, a tenant's bad behavior and the landlord's decision to stop renting out units in the building.

    Security Deposits

    • California law requires that security deposits be refundable entirely, even if a lease or rental agreement stipulates that part of a deposit is "non-refundable." In San Francisco, landlords also must pay interest annually on your security deposit.
