California Labor Law Vacation Policies
The California Legislature has established laws and provisions for any companies offering vacation time to employees. These rules were established by the state of California to ensure fairness in relation to vacation policies.

Vacation Law

California does not legally obligate any company to provide vacation time for employees. It is up to employer discretion to offer paid vacation or unpaid vacation options. If an employer does offer either paid or unpaid vacation time to employees, there are laws in place that regulate vacation policies so employees are treated fairly.
Vacation Accrual

Companies that do offer vacation time are required by law to have a policy in which vacation time is earned or vested based on hours worked. Vacation time should earn up in relation to how many hours have been worked or how many years an employee has been with the company.

Employee Termination

Companies that have chosen to offer vacation time are lawfully obligated to pay the employee for any unused earned vacation time when the company terminates the employee. This should be paid out at the hourly rate of the employee at the time of termination.
