Maternity leave in New Jersey falls under the New Jersey Family Leave Act, which allows workers to take a leave of absence from their job for family reasons, including pregnancy.

You must have worked for your employer for at least a year (for at least 1,000 hours) to qualify for the NJFLA. You may not be eligible for the NJFLA if your salary is within the highest 5 percent of your company or if you are one of the seven highest-paid employees in the company if it can be proved that the company would greatly suffer in your absence. Thirty days' notice must be given to your company to receive your maternity NJFLA benefits.

You are entitled to 12 weeks of maternity leave under the NJFLA. You are also entitled to the same or an equivalent position with your company when you return unless a layoff has occurred.

If you think your maternity leave rights have been unlawfully denied to you, it is your right to have your case investigated by the N.J. Division on Civil Rights, which is a free service.
