Uncontested Divorce Agreements
When a divorcing couple is able to settle the details of their split between themselves, their divorce is uncontested. There are several advantages to an uncontested divorce, which usually takes far less of an emotional toll than a divorce that is contested.
-
Divorce Issues
-
In an uncontested divorce, a couple is in agreement regarding the decision to divorce as well as the grounds for divorce. In addition, the couple also agree on how to divide their property, manage custody of their children and handle any ongoing financial support, such as alimony.
Time Frame
-
Uncontested divorces can proceed much more quickly than contested divorces. In an uncontested divorce, a spouse or couple presents a judge with their divorce agreement for approval. In some states, a couple with a simple divorce may not even need to appear in court.
-
Cost
-
In an uncontested divorce, lawyers are sometimes not even needed. The spouses can draw up their own divorce agreement. If a couple doesn't feel comfortable doing this, many lawyers charge a flat fee for drawing up an uncontested divorce settlement.
