Debit Card Fraud Rights

As the use of debit cards continues to grow, so do the incidents of debit card fraud. Consumers have certain rights if they are victims of this kind of fraud.

  1. Methods

    • Thieves can access the money in your bank account just by getting access to your personal identification number and other account information. They could use a technique called skimming to capture your information when you use your debit card at the ATM, retail stores, restaurants or gas stations.

    Prevention

    • You are more likely to encounter debit card fraud at gas stations, so it is preferable not to use your debit card PIN at these retailers. ATMs at banks are safer than those at other places. And keep track of your bank accounts.

    Rights

    • You will not be responsible for more than $50 in fraudulent charges under federal law, provided you report the lost or stolen debit card or PIN within two business days of finding out about it. If you don't report any unauthorized charges within 60 days after the mailing date of the statement listing the charges, you may be liable for any unauthorized withdrawals afterward.
