Hawaii Renter's Rights

According to the University of Hawaii's Housing Department, renters in Hawaii are covered by federal law under the Fair Housing Act; and state law covered in the Handbook for the Hawaii Residential Landlord-Tenant handbook.

  1. Agreements

    • The Landlord Protection Agency website reports Hawaiian law covers both written and oral tenancy agreements that are legally binding. These agreements cover a number of factors including how, why, where and the amount of rent to be paid by the renter.

    Security Deposits

    • The Landlord Protection Agency explains security deposits in Hawaii cannot exceed one month's rent and must be returned within 14 days of the termination of tenancy. Security deposits can only be withheld from a renter by a landlord to repair damage and clean a property. Deposits can also be used to replace unpaid rent or deposits for unreturned keys.

    Changes and Notice

    • Changes to tenancy agreements can be made by both the renter and landlord if a notice of 45 days is provided. To terminate a tenancy agreement, both landlord and tenant must also provide 45 days notice.
