A letter breaking a lease agreement can present a sometimes stressful situation for the tenant. The letter should clearly inform the reader as to why the tenant needs to terminate the lease. In so doing, the objective is to break the agreement without any consequences imposed on the tenant.

  1. Notice

    • As a matter of professionalism, provide advance notice as far out as possible to the landlord before deciding to move out. The landlord needs time to prepare and advertise for a new renter. Advance notice may invite a more forgiving landlord when it comes to allowing the tenant to escape from under the lease.

    Circumstances

    • Inform the landlord that due to circumstances beyond the tenant's control, the tenant cannot stay throughout the full lease term. Examples of such circumstances may include health reasons, family issues or transfer of employment to another area.

    Premises Issues

    • Many states have the implied warranty of habitability or similar law requiring a safe place to live for tenants. If the premises are overburden with repairs, the letter citing examples of major items that require maintenance becomes a viable cause to break the lease agreement.

    Concessions

    • The letter breaking a lease agreement does not have to introduce the concept of negotiating the lease termination. If needed, work out a separate agreement with the landlord. The best outcome from a tenant's perspective imposes no conditions upon leaving the tenancy.
