The Pennsylvania Military Leave of Absence Act helps protect members of the military from workplace discrimination.

The Pennsylvania Military Leave Act is a law designed to prevent members of the military from losing their jobs when ordered to participate in military service activities. Both employers and employees have responsibilities to each other under this law.

  1. Paid Leave

    • The Pennsylvania Military Leave Act requires employers to allow members of the armed services 15 paid days off per year to perform their military service. When a military service member is required to attend to her military duties for a period of 30 days in a row, employers must extend her number of paid leave days from 15 to 30. This extension does not apply to solders called away for training purposes.

    Coming Back

    • When a member of the armed forces returns to work after taking leave to perform military service, he must be allowed to resume his previous position whenever possible. If returning him to the same position is not possible or practical, he must be granted a position that is similar in pay, seniority and status.

    Insurance

    • Pennsylvania employers are required, at their expense, to continue the insurance coverage held by military members who take a military leave of absence. The employer must do this for up to 30 days, At the end of 30 days, the employer may elect to discontinue the employee's coverage, but not without first giving her an opportunity to continue the coverage at her own expense. If the employee chooses to continue the insurance coverage on her own, she may not be made to pay more than what her employer was paying.
