What Happens to Your Car When You Are Arrested for a DUI in Detroit?
According to the Michigan Department of State's website, driving while under the influence of alcohol or drugs is designated as driving while visibly impaired (OWVI), or driving while intoxicated (OWI).
-
First Offense Vehicle Penalties
-
Even if it is a Detroit driver's first OWI or OWVI offense, the state of Michigan may immobilize the driver's vehicle upon arrest. Ignition interlocks may also be installed for first-time OWI offenses.
Second Offense Vehicle Penalties
-
A Detroit driver in violation of a second OWI within seven years will have his vehicle immobilized for 90 to 180 days, and is danger of both ignition interlock installation and vehicle confiscation. If a Detroit driver is arrested with an OWVI, his license plate will be confiscated for 90 to 180 days, and his vehicle may be forfeited by the state.
-
Third Offense Vehicle Penalties
-
In Michigan, Detroit drivers with a third OWI or OWVI offense within their lifetimes are subject to a license plate confiscation, vehicle immobilization of one to three years, complete vehicle forfeiture and the rejection of all future vehicle registrations.
Vehicle Transferring Laws
-
Michigan law forbids any transfer of forfeited license plates, registration or forfeited or immobilized vehicles to a family member if convicted of a OWI or OWVI.
