Oklahoma tenants are protected by the state.

In Oklahoma, the Residential Landlord and Tenant Act governs the tenant and landlord relationship. The Residential Landlord and Tenant Act was created in 1978, but is constantly amended to clarify the rights of tenants and landlords.

  1. Significance

    • Under the act, landlords have certain obligations. For example, landlords have a responsibility to maintain the condition of plumbing, electrical systems and heating. The landlord must ensure the systems are in safe, working order.

    Heat and Water

    • A landlord's inability to provide a tenant with water or heat can make a dwelling unit uninhabitable. If a landlord is not compliant with supplying a tenant with heat and water, the tenant has a legal right to break the lease.

    Tenant Considerations

    • Tenants do not have a right to use their dwelling place or unit for any purpose other than residency. For example, if the tenant uses the unit as a place of business it could constitute a breach in the rental agreement.

    Trash Receptacles

    • Oklahoma landlords have a duty to supply their tenants with trash receptacles if the dwelling has more than two residents. The only time trash receptacles do not need to be provided is if they are already provided by a government entity.

    Lease Amendments

    • Landlords do not have a right to amend a lease after it is signed. Any amendments, rules and regulations added to a lease must be for the convenience and safety of the tenant. However, tenants are only subject to new rules in their lease if they consent to the new rules in writing.
