Drug trafficking is a felony punishable by imprisonment.

Drug trafficking is a felony referring to the manufacture, sale, distribution (or intent to distribute) and smuggling of illegal drugs, such as heroin, cocaine, ecstasy, methamphetamine and marijuana. Convicted drug traffickers are sentenced according to mandatory minimum guidelines.

  1. Minimum Guidelines

    • Minimum sentencing guidelines are based on the potential for abuse, dependency and health risks of the drug, as classified by the Controlled Substance Act.

    First Offense

    • The first offense of trafficking in cocaine, heroin, LSD or methamphetamine carries a mandatory minimum sentence of 5 or 10 years imprisonment and a fine of up to $4 million. Minimum imprisonment and fine depend on the amount of the drug involved in the offense.

    Second Offense

    • Second conviction for the same offense results in a minimum sentence of 10 or 20 years and a fine of up to $8 million. Minimum imprisonment and fine depend on the amount of the drug involved in the offense.

    Subsequent Offenses

    • Convictions after the second offense carry a mandatory sentence of life imprisonment.

    Exceptions

    • The mandated minimum sentence may be waived if the offender provides significant aid in prosecution of another offender or for nonviolent, first-time offenders who meet eligibility criteria.

    Government Assistance

    • Offenders convicted for any drug-related felony are ineligible to receive government assistance programs such as welfare, food stamps and public housing.
