A third DUI conviction in Arizona is a felony offense and comes with very serious penalties.

A third DUI conviction in Arizona within a seven year period, is considered a class four felony, and is punishable by severe penalties, including jail time. The type of DUI will dictate the specific penalties, if found guilty. DUIs receive the most lenient penalties, followed by extreme DUIs, and, then, aggravated DUIs, which receive the strictest penalties.

  1. Jail Time

    • If foudn guilty, you will be jailed for no less than three months and no more than two years, dependent upon the type of DUI.

    Probation

    • In addition to fines and imprisonment, you can also be placed on probation for up to five more years.

    Fines

    • You face fines of up to $150,000. Additionally, you will can be ordered to pay an additional $250 to the Arizona DUI abatement fund. Various additional court fees as well as your own legal costs will be accessed.
