Fair Labor Standards Act Compliance
The Fair Labor Standards Act was passed in 1938 and established federal labor laws that are still in effect today. Compliance with the law is mandatory and regulated by the Wage and Hour Division of the Department of Labor.
-
Workweek
-
The maximum amount of time in a single workweek to be compensated at the normal pay rate is 40 hours.
Overtime
-
Any work done in excess of 40 hours in a single workweek will be compensated at one and one-half times the normal pay rate.
-
Wages
-
The latest update to federal minimum wage was an increase to $7.25 an hour, as of July 2009. Workers in states with a higher minimum wage rate than the federal rate are entitled to receive the greater of the two.
Record-Keeping
-
Employers must keep records tracking employees’ time and pay records. Payroll records must be kept for three years; wage computation records for two.
Postings
-
Federal law requires that employers of covered employees display the FLSA information poster in a place visible to employees. Copies of the poster can be downloaded from the Department of Labor website or ordered through the Wage and Hour Publication System. Their phone number is 1-866-4USWAGE (1-866-487-9243).
