Commonwealth of Pennsylvania DUI Law
Like many states, driving under the influence in Pennsylvania is a serious offense. It is important you understand how the law operates in Pennsylvania so you don't get a DUI, and what to do if you are caught driving under the influence.
-
Types
-
Penalties in Pennsylvania are based on your blood alcohol content (BAC) at the time when pulled over. Levels between .08 and .099 incur the lowest penalties, while anything over .16 invokes the highest.
First Offense
-
If you have a low BAC, you can face six months probation and a $300 fine. If your BAC is .10 to .159, you face between two days and six months in jail, a fine between $500 and $5,000, and a suspended license for 12 months. For people with a BAC over .16, you face similar penalties, but a fine of $1,000 to $5,000.
-
Second and Third Offense
-
If you are caught more than once for a DUI, your jail time, fines and suspension of license will increase.
Interlock Device
-
People with repeated DUIs in Pennsylvania will also require the installation of an ignition interlock device. This will require the driver to blow into a device that proves they are not under the influence before the car will start.
School
-
All people charged with a DUI in Pennsylvania will also need to attend alcohol highway safety school as a part of the punishment.
