Mississippi Residential Landlord Tenant Act
Landlords and tenants in Mississippi have rights and responsibilities granted to them under Mississippi's Residential Landlord Tenant Act. These include notice of tenancy termination, return of security deposits and the responsibility of both parties to properly maintain the rental unit.

The Act

The Mississippi Residential Landlord and Tenant Act outlines the rights, obligations and remedies in Mississippi under any rental agreement entered into after July 1, 1991. This applies only to residential leases, not condos, co-ops or land used for agriculture.
Landlord Obligations

Landlords in Mississippi are required to maintain their properties according to code and ensure that heating, cooling and plumbing systems are operational.

Tenant Obligations

Tenants are required to pay their rent on time and to keep their homes clean, sanitary, and to not cause damage to the home or its appliances.
Termination of Tenancy

If the tenant is on a month-to-month or week-to-week rental agreement, the tenancy can be terminated with 30 days or seven days notice, respectively.
Security Deposits

The landlord must return the security deposit within 45 days after the lease or rental agreement ends and must provide to the tenant, in writing, an itemized list of any deductions.
Repairs

If repairs are needed on the property and the tenant did not cause the damage that requires repair, the tenant can make a written request for repairs to the landlord. If the landlord fails to make the repairs, the tenant can make the repairs herself and request reimbursement.
