Florida has mandatory car seat and seat belt laws for children. According to the National Transportation Safety Board, placing a child in a seat belt and in the back seat is the safest place for them to ride in a car.

  1. Car Seat

    • A car seat is mandatory for any child three years of age and younger. The car seat must be a federally approved one. Rear facing car seats cannot be used in the front seat due to airbags.

    Booster Seat

    • Children who are four to five years old may ride in a car seat, booster seat with a seat belt or just with a seat belt.

    Fines

    • For a child who is not appropriately restrained in a seat belt or car seat the fine is $60. The fine is $30 for a driver or adult over the age of 18 not wearing a seat belt.

    Tip

    • Any person riding in the front seat must wear a seat belt. People under the age of 18 riding in the backseat are not required to wear a seat belt.

    Warning

    • Florida is now a primary offense state which means a driver can be pulled over just for not wearing a seat belt. Before June of 2009, an officer could only ticket an individual for not wearing a seat belt only if they had committed another moving violation.
