Renter's Rights of Habitability

Every state has some legislation regarding a renter's right to a habitable and safe dwelling during the duration of tenancy. Exact laws vary from state to state, but there are some common factors in determining habitability.

  1. Water

    • Property owners must provide their tenants with enough water, both hot and cold, and under adequate pressure, to meet the needs of normal household activities. If the lease dictates, a tenant may be charged for water usage.

    Pests

    • All occupied rental properties must be free from pests in order to maintain a safe and healthy environment. Common pests include rodents, cockroaches and other insects.

    Heating

    • Landlords must supply adequate heating, especially in areas with colder climates, though tenants commonly pay for the fuel or electricity required to heat their home.

    Structural Integrity

    • Occupied structures must always be free from building code violations. Structures must be in good condition, and protect occupants from rain, wind, snow or other elements.

    Considerations
