Is Pepper Spray Legal in Sacramento?

Pepper spray is made from oleoresin capsicum, a derivative of hot cayenne peppers. Contact with pepper spray causes burning of the skin, coughing and temporary blindness. Alana Henley of the Sacramento, California Police Department states that "pepper spray is an adequate method of self defense."

  1. Where it is Legal

    • Pepper spray is legal for use as personal protection in all 50 states as long as it is used properly and only when you feel threatened. Individual towns or cities may have limited or prohibited use in their jurisdictions.

    California Law

    • California law limits the amount of pepper spray carried for personal use to 2.5 oz. In Sacramento, the amount is limited to 0.5 oz. Misuse of pepper spray can carry fines of up to $1,000 or up to 3 years in jail. Pepper spray cannot be sold to minors in California. Every bottle must be labeled, "WARNING: The use of this substance or device for any purpose other than self-defense is a crime under the law. The contents are dangerous--use with care."

    Bans

    • Pepper spray may not be carried on commercial airlines, although it can be carried in checked bags. Violation is a federal crime carries a maximum $25,000 fine. Many federal and state buildings also prohibit anyone from carrying pepper spray.

    Common Uses

    • Pepper spray is a defense weapon utilized by police, prison guards, private security guards and most people involved in the defense industry. Mailmen carry pepper spray to guard themselves against dog attacks. Hunters and rangers frequently carry pepper spray to ward off bear attacks.

    Warnings

    • When using pepper spray against an attacker, be careful not to hold your arm out in front of you when you spray. The attacker can easily grab the can out of your hand. Pepper spray reactions differ from person to person, incapacitating them for varying lengths of time. As soon as you spray, run away from the area and yell for help.
