Criteria for Determining Child Custody

Determining what is best for the child is the main criteria in child-custody cases. The courts will look at evidence and hear from witnesses to make the decision on what is in the best interest of the child.

    Financial Stability

  1. The courts will look at the ability of each parent to provide food, shelter, clothes and medical care for the child.
  2. Health

  3. The mental and physical health of each parent will be assessed to determine child custody by the court.
  4. Child Safety

  5. Reports of abuse are taken very seriously. If there is a substantiated claim of abuse, the courts will place the child in the environment they believe is the safest.
  6. Parental Bond

  7. Often, children have a stronger emotional bond with one parent. The court will take this into consideration before deciding child custody.
  8. Child's Preference

  9. In most cases, the child's preference will be considered if he is around 12 years old. This will not be used as the main criteria. Some children will choose the parent they believe will be more permissive.
