MP3 Copyright Laws
MP3 files might live exclusively in the digital world, but the same copyright rules that apply to books, paintings and compact discs still apply.
-
When a Copyright is Granted
-
A copyright is automatically created once an MP3 file is created.
Three Parts of Copyrights for Songs
-
The lyrics, musical composition and performance are copyrighted separately. The first two allow a songwriter to use a C-in-a-circle symbol; the third grants a P-in-a-circle.
-
Length of Term
-
Copyrights are good for 70 years after the death of the last surviving copyright holder. In the case of a work-for-hire, the copyright is good for 95 years after publication or 120 years after creation, whichever comes first.
License for Use
-
The copyright holder has the sole right to grant a license for use of the MP3 file, with or without restrictions or fees. Some copyright holders opt for a Creative Commons license, which allows for free use of the file under certain conditions.
Copyright Procedures
-
A copyright registrant (or assignee) goes to the eCO section of the U.S. Copyright Office website, files fill-in Form CO, pays a fee and uploads her MP3 file.
