Facts About Criminal Justice

Criminal justice is the system of law enforcement, attorneys, the courts, the prison system and the parole and probation system that are directly involved in the investigation, arrest, trial, sentencing, imprisonment and supervision of criminal defendants.

Police

The police are on the front line of the criminal justice system and are responsible for the first step of the criminal justice system. They are responsible for investigating and apprehending those suspected of crimes. They are also charged with crime prevention, and it is believed that their presence and programs are designed to improve the communities that they work in.

Trial

The next step in the process involves the judicial system. This includes a prosecutor who is charged with proving that the crime occurred and a defense attorney who is charged with protecting the rights of the accused. The defendant is generally entitled to a public defender if he cannot afford to hire a private attorney.

Police at Trial

The police work closely with the prosecutor to prove that the elements of the crime alleged actually occurred. The police share the facts gained from their investigation and the evidence collected with the prosecutor's office.

Judge versus Jury

In most criminal trials, the defendant has three choices for proceeding. He can plead guilty and avoid trial, he can have a trial before a judge with no jury or he can have a jury trial.

Incarceration

If the defendant is found guilty, he will usually be incarcerated. Other possible punishments include probation, restitution, community service and required treatment.

Probation

Generally after incarceration, a judge will include a period of probation during which the defendant is required to meet certain conditions. Common conditions include reporting to an agent, obtaining work, attending drug treatment programs and keeping the court informed of living conditions.
