Types of Divorce Attorneys
Divorce attorneys provide various types of services to their clients. While all divorce attorneys handle divorce procedures on behalf of their clients, there are some divorce attorneys who concentrate or have expertise in other divorce-related areas.
-
Contested and Uncontested Divorce
-
All divorce attorneys will handle not only contested divorces, but uncontested divorces, as well. A contested divorce is one in which the spouses do not agree to the divorce and/or terms of the divorce, while an uncontested divorce is one in which the spouses agree to the divorce and to the settlement of all issues related to the divorce.
Child Issues
-
Some divorce attorneys have an expertise in the settlement of child issues. Child issues include child support, child custody and child visitation rights of each spouse.
-
Spousal Support Issues
-
Divorce attorneys may possess an expertise in spousal support matters. In a spousal support matter, the primary issue is how much alimony will be paid. Alimony is the payment of money to one of the spouses upon the divorce of the couple.
Mediation
-
In instances where the parties seek to work out their problems without going to the court to decide, mediation may be an option. Mediation is a forum wherein the parties agree to have a neutral third-party review the pending matter and make a determination. Some divorce attorneys have training in mediation and possess an expertise in acting as a mediator.
Property Distribution
-
In addition to spousal financial support matters, divorce attorneys may also possess expertise in handling the issue of property distribution. Property distribution involves the separation of the assets of the spouses and dividing the assets between the two individuals.
