Legal Requirements for Home Daycare in North Carolina

Working from home can be a rewarding way for mothers to earn extra income. For those who choose to be a licensed home daycare provider in North Carolina, there are some regulations to follow.

    Maximum Number of Children

  1. According to the NC Department of Health and Human Services, a home care provider can have up to five children at the age of preschool or younger. Up to eight children are allowed if three or more are school-aged children.
  2. Application Packet

  3. An application packet can be obtained by calling the NC Division of Child Development at 1 (800) 859-0829. You will mail it to your consultant, who will then call to schedule an in-home visit and help you complete the process.
  4. Background Check

  5. A criminal background check must be completed as part of the application process. In addition, any household members 15 years and older who are present during operations must complete a check, according to the NC Department of Health & Human Services.
  6. Handbook

  7. A handbook containing all forms, laws and procedures is available for purchase from the NC Division of Child Development. These laws must be followed in order for you to maintain your license.
  8. Workshops

  9. Informational childcare workshops are offered to help you through the process. Your local agency will provide you with details.
  10. Home Visits

  11. Unannounced visits are made on a regular basis to ensure compliance with laws and regulations. In addition, homes that receive complaints will be visited and investigated if necessary.
