What to Expect in a Divorce Separation

Divorces and separations are significant life events which affect the former spouses and their children. The ramifications of separating/divorcing cover emotions, legal issues, emotional fallout, and support for the children and former spouse.

  1. Legal

    • Expect legal motions (separation/divorce, court orders for visitation, temporary custody, temporary spousal support, and filing regarding assets). Negotiations will begin regarding issues such as the children, alimony and ownership of the house and property.

    Emotional

    • You may feel relief that the decision to separate or divorce has been made; you may grieve, as if your spouse has died. Expect to feel grief, fear, regret, shame, and possibly resentment towards your (former) spouse.

    Children

    • Your children are going through your divorce just as much as you are. They may be feeling things like fear, anger and self-blame. Expect your children to express their feelings in ways they normally don't.

    Child Support

    • Child support is intended to help the custodial parent cover expenses for children after divorce. This money is intended to pay for the needs of the children; this is at the discretion of the custodial parent.

    Alimony

    • Alimony is intended to help the former spouse with support and maintenance. It is paid upon a written and signed order by the court. If your state has a "cohabit" clause, your alimony could end upon your moving in (yet not marrying) a new partner.
