A real estate agent is licensed by the state's real estate department, in the state where he does business. Agents are required to follow specific advertising guidelines when placing ads. Failure to comply with some of the regulations can result in severe fines.

Identify the Broker

Real estate agents must always identify their broker on all advertising, including print and Internet ads.

Licensing Status

Real estate agents must identify their licensing status on their advertising. They must state if they are a broker or sales licensee.

Warning

Advertising must not be misleading--it should be a fair representation of what is being sold.

Function

All advertising for housing must contain a Fair Housing logo.

Types

Certain types of language should not be used in the advertising of a real estate agent. This includes verbage that discriminates in regards to race, color, national origin, religion, sex, handicap or familial status.

Features

When mentioning detailed mortgage terms real estate agents must comply with Regulation Z guidelines. Vague terms such as "terms available" are allowed.
