Laws Regarding Car Accidents

When a car accident happens, there are certain procedures individuals involved in the accident must follow to avoid legal or insurance problems. Each state has individualized laws regarding car accidents, but most states have similar if not identical actions that must be taken after a car accident.

Leaving the Scene

When an individual is involved in a car accident, he must not leave the scene. Even if the accident was minor, both parties involved must remain at the scene until lawful actions are completed.

Identification and Proof of Insurance

When more than one vehicle was involved in an accident, all parties must exchange identification and proof of insurance.

Call the Authorities

Report the accident to the police while still at the scene. Individuals will be asked a series of questions about possible injuries or estimation on vehicle damage.

Move the Vehicles

If the accident was minor and the vehicles are operational, drivers should move the cars off of a road where there is other traffic. This will help avoid more accidents. If in doubt as to whether moving the vehicle is advisable, individuals should ask the police when they call to report the accident.

Report the Accident to the DMV

Report the accident to the local Department of Motor Vehicles (DMV) as soon as possible after a car accident.

Contact Insurance Providers

Drivers should report accidents to their insurance companies within 24 hours of an accident regardless of how minor it was.
