New Jersey law protects consumers who purchase a new vehicle that proves to be a lemon; that is, one that has unexpected defects. The law requires that the seller of the vehicle repair the defects, replace the vehicle or fully refund the purchase price.
Most car dealers would refrain from intentionally selling cars that are defective because such a tactic would damage that dealer's reputation, strip him of his credibility and persuade shoppers to buy elsewhere. However, sometimes a dealer is unaware that a vehicle is defective until after it has been sold, and other times dealers sell vehicles that they know are defective because they are desperate for money. Because of this problem California has enacted a lemon law to protect consumers from being sold "lemons," or defective automobiles, trucks, and RVs.
The term "Lemon Law" refers generally to a number of laws enacted in various states in the United States to protect consumers from poorly made automobiles and disreputable auto dealers. The specific statutes differ from state to state, but they all attempt to ensure that people who buy a truck---or other vehicles---are adequately informed of the quality of the vehicle before they buy it and are protected from defects that may substantially impact the usability or safety of the vehicle afterward. Lemon laws tend to treat trucks and cars in the same way.
Every state has its own lemon law. While each contains similar provisions, some differences do exist, such as covered vehicles, protection period and acceptable means of dispute resolution. Wisconsin lemon law, like most states only applies to new vehicles. In Wisconsin, the Department of Transportation's Dealer and Agent Section handles questions about the lemon law and can serve as a resource for more guidance, but it does not directly resolve disputes.
The Florida auto lemon law is found in Chapter 681 of the Florida State Statutes and is legally referred to as the "Motor Vehicle Warranty Enforcement Act." A lemon is defined as a vehicle that has been serviced for the same problem at least three times or that has been in a service center or several service centers for 15 or more cumulative days.
