What Is HUD 24 CFR?

The Code of Federal Regulations (CFR) is a collection of regulations issued by federal agencies. These are regulations that have "general applicability and legal effect," according to Cornell University Law School. The code is divided into 50 titles, including Title 24 Housing and Urban Development.

  1. Function

    • The Titles in the Code of Federal Regulations correspond to different government agencies or initiatives. For instance, Title 6 is titled Homeland Security and Title 31 is Money and Finance: Treasury. Title 24 is dedicated to the regulations concerning the Department of Housing and Urban Development (HUD).

    • Title 24 is divided into two subtitles, A and B, which focus on different areas of the administration of HUD. Subtitle A is entitled Office of the Secretary, Department of Housing and Urban Development. Subtitle B deals with Regulations Relating to Housing and Urban Development. Generally, A deals with internal issues for HUD while B is concerned with interactions between the department and external departments and legislation.

    • Subtitle A deals largely with issues concerning the administration of HUD. Among the topics covered are a code of conduct, nondiscrimination provisions and standards for administrative hearings. This section also establishes standards for programs administered by HUD, such as the Home Investments Partnership Program. The establishment of the Mortgagee Review Board by the National Housing Act and provisions detailing its operation and authority are also included in this section.

    Subtitle B

    • Dealing with HUD-oriented legislation and the implementation of various laws, Subtitle B is primarily concerned with regulatory matters. Detailed within this section are the expectations placed upon HUD to follow standards of equal opportunity; discriminatory practices contrary to the Fair Housing Act are expressly prohibited. Among the provisions included within Subtitle B is the introduction to Federal Housing Authority (FHA) programs. FHA falls under the authority of HUD, and the standards for implementing FHA programs are specified in this section.

    Considerations

    • The authority and limits of regulations appearing in the Code of Federal Regulations are set by federal statutes. These statutes, collected in the U.S. Code, should be considered along with the regulations appearing in the CFR. According to Cornell University Law School, courts may hold the regulations as invalid if they conflict with federal statutes.
