Arizona DUI Information
Arizona DUI (driving under the influence) laws prohibit a driver from driving with a blood alcohol concentration (BAC) of .08 or more. A driver that is under the age of 21 years cannot have a BAC of .02 or higher and a commercial driver that holds a CDL such as a truck driver, cannot have a BAC of .04 or higher. Drivers that are stopped and arrested for DUI in Arizona will face fines and penalties.

First DUI Conviction

The first conviction DUI will result in a base fine of $250, which can increase with aggravating circumstance, an Arizona surcharge of $200, a $10 probation surcharge, a $500 prison construction assessment and a $500 Xtra DUI assessment. The jail sentence can be 24 hours to 10 days and the license is suspended for 90 to 360 days.
Second DUI Conviction

The second DUI conviction results in a base fine of $500, which can increase with aggravating circumstance, an Arizona surcharge of $400, a $10 probation surcharge, a $1,250 prison construction assessment and a $1,250 Xtra DUI assessment. The jail sentence can be 30 to 90 days and the license is suspended for one year. Community restitution can be a 30 days minimum. The court can order treatment programs, education programs and alcohol and drug screening.

Third DUI Conviction

The third DUI conviction results in a base fine of $750, which can increase with aggravating circumstance, an Arizona surcharge of $600, a $10 probation surcharge, a $1,500 prison construction assessment, a $1.500 Xtra DUI assessment and a $250 DUI abatement fee. The license is suspended for one year and jail time can be four months or more. The court can order treatment programs, education programs and alcohol and drug screening.
Extreme DUI Convictions

Extreme DUI convictions are for offenders driving with a BAC of .15 or higher. The conviction is a criminal misdemeanor. The first offense is punishable with a $900 fine, $250 for the required DUI assessment and $1,250 for the required extreme DUI assessment. The driver's license is revoked for one year and the ignition interlock device is required for a time to be determined by the court. The second extreme DUI within five years of the first is punishable with a $450 fine, $250 for the required DUI assessment and $1,000 for the required extreme DUI assessment. The license is suspended for 90 days to one year and the ignition interlock device is ordered.
Ignition Interlock Device

The ignition interlock device is installed in the vehicle. It does not allow the vehicle to be started until the driver blows into and has his blood alcohol concentration analyzed. If the driver does not have a BAC, the vehicle can start, if there is a BAC, the ignition interlock stops the vehicle from being started. The device can be ordered for all offenses including extreme DUI convictions.
