Who Can Check DMV Records?

Access to driving records is limited.

According to the United States Department of Justice, the Freedom of Information Act does not "create a right of access to records held by Congress, the courts, or by state or local government agencies." Department of Motor Vehicle records fall under state jurisdiction. Automobile titles and driving record abstracts qualify as public records. However, the Drivers Protection Act allows only individuals and entities demonstrating permissible use access to individual driving records.

Individual

An individual may request his personal driving record at any time. Request records in person at the local Department of Motor Vehicles Branch Office, online or in writing. Find local offices on individual state websites. Driving records fall under the jurisdiction of the Secretary of State office in some states.

Parent

The Drivers Protection Act applies to both adults and teens.

A parent may request her minor child's driving record only with the driver's consent. The minor driver grants permission in a written and notarized document.

Verification

Employers and insurance companies may verify information submitted by the applicant against motor vehicle records. Use includes verifying ownership of an automobile asset claimed by the individual and verification of a driving record to assess an insurance rate.

Safety

The police department may access DMV records.

Law enforcement and other government agencies access records in the course of enforcing public safety. Law enforcement checks automobile records to notify an owner of a recovered stolen vehicle. Agencies record and assess traffic violations. Criminal investigations may require access to driving records.

Marketing

The DMV issues surveys.

Agencies compile driver contact information for surveys. However, individuals may opt out. Surveys and polls allow citizens to weigh their opinions on the efficiency and proposed services of the Department of Motor Vehicles.
