Neck Injuries
According to National Safety Council records, not only are neck injuries common in automobile collisions, they also are among the hardest injuries to identify both for medical and legal purposes. While some neck injuries are apparent immediately following an accident, in many instances this is not the case. Days and sometimes even weeks can elapse before the extent of a neck injury is known. Here are some steps you should take if you believe may have injured your neck in an accident.
-
Document Accident Promptly
-
The first step is to document exactly what occurred at the time of the accident. This includes obtaining the names and contact information from any and all witnesses. If possible, also obtain a written statement from each witness to your accident.
Medical Attention
-
Seek medical attention if you believe you have suffered a neck injury. This is important for your own health and for documenting the extent of your injury, if you elect to file a claim or a lawsuit down the road. Because of the nature of neck injuries, also schedule follow-up examinations with your doctor. Also make sure to obtain records of all examinations to support any claim or case you may pursue.
-
Other Documentation
-
In addition to being compensated for any medical expenses and pain and suffering you sustain as the result of a neck injury, you also are entitled to compensation for lost wages and expenses. Collect any documentation that supports a claim for lost wages and other losses you sustained as a result of the accident.
File Claim in a Timely Manner
-
File any initial claim in a timely manner. Promptly contact your insurance company as well as the insurance company of the business or individual you feel is responsible for any injuries.
Qualified Legal Representation
-
Neck injuries and related claims and lawsuits are complex. There are property injury attorneys who focus on these types of cases. Find a list of lawyers in your area who specialize in personal injury cases by contacting the local or state bar association. Keep in mind these organizations cannot make specific recommendations.
