What Are the Types of Probation Violations?

Probation is a court sentence given by a judge to an individual to prove her worthiness to remain a member of society. Probation is usually given to offenders who commit misdemeanors in lieu of a prison sentence and can last up to a few years, depending on the offense. Probation is also given for a period following the release from a county jail. A person must adhere to strict rules while on probation, including reporting to a probation officer. Violating probation for any reason could land a person in prison.

Failure to Appear or Report

A defendant is often required under probation to attend scheduled court appearances, usually for a progress report. A defendant is also required to meet at least monthly with a probation officer, who monitors a defendant's compliance with the terms of the probation. Failure to meet with the probation officer or attend a scheduled court hearing could result in a violation and imprisonment.

Failure to Pay or Comply

A defendant may be required to pay fines and restitution as part of her probation. A defendant may also be required to undergo rehabilitation, usually for drug offenses, or submit to community service.

Violating Rules of Probation

Possessing drugs or illegal weapons and/or being arrested for a crime are considered probation violations. A probation sentence, usually from drug offenses, could include prohibitions from visiting certain locations and/or certain persons. Not adhering to those prohibitions could also be considered violations.

Consequences

Violating probation could result in any number of disciplinary actions, including an extension of probationary period, revocation of probation, community service, admittance to a treatment or rehabilitation program, counseling and/or prison.
